Don't let this happen to your driveway!
On 03/09/2022, there was snowfall in Atkinson NH. Mr. Moody and I had had previous discussions about how not to plow when the snow accumulation was not great, and the ground was not frozen. The weather reports (before the snowfall) indicated that the weather for the next two days after the snowfall was going to be in the 60's, and, that the snow accumulation would not be great. Actually, the day after the snowfall, the majority of the snow was melted\gone.
I do not have a paved driveway. I have a rather long driveway, and then a large clearing, and it was covered in rolled down recycled asphalt. It looked nice. When not frozen, (because we had had warm and wet weather in the days before the coming snowfall), it would not have been advisable to plow. Mr. Moody did not call to determine if I wanted my driveway to be plowed this time (as he had done in previous similar circumstances). This time, he just went ahead and plowed that evening.
After the plowing, the next morning, most of the recycled asphalt was no longer on the driveway and was instead in piles along the sides of the driveway, and on the lawn. The piles were not just snow, but the asphalt and the gravel\rocks and dirt that had been underneath it. There were multiple gouges in the driveway from the plow blade, and the level of the land in places had been changed.
The opening image of this site (above), that I took the next day (3/10/22, at 1:30 PM), shows the recycled asphalt piled along the side and end of the driveway past the garage, instead of being on the driveway, including the rocks and dirt that had been underneath the recycled asphalt. You can also see clearly that the driveway is basically down to dirt. Note that the snow is already melted where the sun could get at it (basically a little more than 1/2 day after the plowing). The image here on the right, I took near the garage, looking back the other way. You can see the line in the driveway, where the plow blade has dug into the driveway and removed the rolled down layer, and that this part of the driveway is pretty much down to dirt to where the driveway curves and go through the woods, and, lower than the other parts of the driveway.
This image is the end of the driveway, beyond the garage. You can see the rocks, asphalt, and dirt that were plowed up way from the rolled driveway, pushed up way higher than can be justified.

This image is right at the corner of the garage, it now dips 4\6 inches (dug deep) instead of there being a slight rise in the driveway, and there is a line (as shown in image above), showing that he took off the top layer there also. You see dirt, not aslphalt.
This picture is of the driveway through the woods, looking out. You can clearly see the recycled asphalt piled on top of the dirt and rocks and snow that was plowed up from the driveway itself. You can also clearly see the areas in the driveway that is down to the dirt,

After taking the pictures before this section, I called Mr. Moody and left a voice message stating how very unhappy I was with what he had done to my driveway. Later that day I heard a noise, looked out the window, and saw that he had pulled back the large piles, and was on his way out, riding on the side of the driveway, pushing those side piles on the lawn and the sides of the driveway, back onto the driveway. Here you can clearly see his tire tracks.
This image, at the end of the driveway, past the garage, shows that awhile he pulled back the piles, he left a lot behind.
On 3/15, I sent a certified letter to Mr. Moody... "On 03/09/2022, there was snowfall in Atkinson. We had had previous discussions about how not to plow when the snow accumulation was not great, and the ground was not frozen. If there had been any doubt in your mind as to whether I wanted a plowing, previously, you would call me. I am sure that, if necessary, a court examination of your records will show that I was not always plowed at the same time as everyone else. You did not call, and you plowed, and totally screwed up my driveway.
A majority of that snowfall was melted before the end of the next day (the temperature was in the 60’s). Before you did this plowing, there had been a layer of recycled asphalt on the driveway. After, most of the asphalt was no longer on the driveway, and was instead in piles along the sides, and on the lawn. The piles were not just the asphalt, but also included the gravel\rocks and dirt that had been underneath it. There were multiple gouges in the driveway from your plow blade; and you changed the level of the land around the garage.
The next morning, I took multiple pictures of all the damage, and then left a message on your cell phone, that expressed my displeasure of how you had totally ruined my driveway. You showed up later in the day and pulled everything back with your plow blade.
So now, instead of a driveway and clearing that has a covering of recycled asphalt, I have a covering\mixture of dirt, gravel\rocks, interspersed with the barely visible recycled asphalt. You went up and down the entire length of the clearing and driveway, pulled back all that you had plowed up (I have pictures of the snow, with a coating asphalt, from before you did this), and while doing this pulling back, you damaged\weakened the sides of the driveway, and messed things up even more. Also, gouges are still there.
After the pull back, I then took more pictures of all of this. I will be getting multiple quotes from different pavers, on the cost of putting down a new layer of recycled asphalt. I have so far gotten one quote of $6,450.00. I expect you to pay for the cost of repairing my driveway, and, to hear from you in a reasonable amount of time. As I stated in the voice message that I left on your cell phone after you did the pulling back…you will no longer be plowing my driveway."
On 3/22/22, Mt. Moody left me a voice message where he stated that "your driveway is perfectly fine, that no one could go in there without loosening up a few stones".
**Actually, ***, today being a few months after that letter, with the time that I have put in, and the additional time and expense to correct the areas around the driveway, I believe that we are probably at $9,000.00 (if not more).
The following images were taken, some shortly after he pulled back the piles, and some since then. This first image shows that the left side of the driveway is a couple of inches lower than what he pulled back from the piles. Not the same height, and certainly not the smooth rolled driveway that it used to be.

On 4/6/22, I sent another certified letter to Mr. Moody. I included the images and text of the first page of this web site, along with the information that I had registered the domain name. Basically, I was hoping that he would realize that by my putting up this site, it could cost him a lot more that the money that I was looking for, to repair the damage to my driveway that he had caused.
On 4\18\22 (after being notified by the post office that there was something for me to pick up), I went to the post office and picked up the certified letter because it had not been picked up by Mr. Moody. Mr. Moody does not have mail delivered to his home, everything goes to his P.O. box (I was told this at the post office), and they pick up their mail there. In other words, seeing that it was another registered letter from me, Mr. Moody left it in the box until it was classified as not having been delivered.
It has been a couple of months since the damage was done to my driveway. Here are some more current pictures. This image shows that grass is growing on the driveway because the top layer was scrapped off.
Mr. Moody pushed the rocks and asphalt 27 feet past the garage and when I mow my blades are being dulled by the rocks.

One of the pop up sprinklers (while it does pop up), is under the asphalt that is on top of the grass, and further down (shown here), one of the sprinkler heads (when it pops up), is at an angle because it must have caught it with the plow blade that was down to the ground level...on the grass, when he went down the edges pushing and pulling the piles that he had created, off of the lawn.
Pulling back the piles and leaving stuff all over the lawn that needs to be manually pulled back, leaving stones and dirt and asphalt along the edges of the driveway and weakening the driveway, creating ruts, leaving areas thinly covered so that vegetation is now growing in it, leaving gouges in the driveway, causing areas of the driveway to no longer be level, losing the rolled and smoother protection and appearance...because of a plowing that never should have happened, is not acceptable.
I have tried multiple ways to get Mr. Moody to respond, he has not done so. The driveway is totally messed up.
If you feel that Mr. Moody should have plowed my driveway when it was not frozen, and with the weather forecasts of 60 degree weather for the next few days, or that it is not really damaged because he pulled back the piles (and thus the driveway can be driven on), and that Mr. Moody has no responsibility to make things right, then by all means...use his services.
